ETHICS AND MALPRACTICE

Indonesian Civil Law Review (ICLR) is committed to maintaining integrity, transparency, accountability, fairness, confidentiality, and academic independence throughout the scholarly publishing process.

All parties involved in publication, including authors, editors, editorial board members, reviewers, and the publisher, PT Makanja Group Publishing, are expected to uphold recognized principles of responsible scholarly publishing.

ICLR refers to the principles and guidance of the Committee on Publication Ethics (COPE) in addressing publication ethics and suspected misconduct.

Ethical Principles

ICLR is committed to ensuring that editorial and publication decisions are based on academic merit, originality, relevance, scholarly quality, and conformity with the journal's aims and scope.

Editorial decisions must not be influenced by nationality, gender, religion, ethnicity, political opinion, institutional affiliation, personal relationships, or other considerations unrelated to academic quality.

The confidentiality of manuscripts and information obtained during the editorial process must be respected by all parties involved.

Responsibilities of Editors

Editors are responsible for maintaining the integrity and academic quality of the journal.

Editors must:

  • make editorial decisions objectively and independently;
  • maintain the confidentiality of submitted manuscripts;
  • disclose and avoid conflicts of interest;
  • ensure that ethical concerns are handled fairly and objectively;
  • protect the integrity of the scholarly record; and
  • take appropriate action when credible allegations of misconduct arise.

Editors must not use unpublished information contained in submitted manuscripts for personal, academic, financial, or professional advantage.

Responsibilities of Authors

Authors are responsible for the integrity, accuracy, and ethical conduct of their scholarly work.

Authors must provide an honest account of their research and must not engage in fabrication, falsification, manipulation of evidence, inappropriate authorship, duplicate publication, undisclosed conflicts of interest, or other forms of academic misconduct.

All individuals listed as authors must have made a meaningful scholarly contribution to the manuscript and must approve the final version submitted for publication.

Gift authorship, honorary authorship, and ghost authorship are prohibited.

Conflicts of Interest

Authors, editors, and reviewers must disclose any financial, institutional, professional, personal, or other interests that could reasonably influence—or appear to influence—the research, review, or editorial decision.

Where a significant conflict of interest exists, the relevant individual must withdraw from the decision-making or evaluation process.

Funding or institutional support related to the research should also be disclosed where applicable.

Research Integrity

ICLR does not tolerate:

  • fabrication or falsification of research findings;
  • manipulation or misrepresentation of data;
  • inappropriate authorship;
  • duplicate or redundant publication;
  • citation manipulation;
  • peer-review manipulation;
  • undisclosed conflicts of interest; or
  • other conduct that compromises the integrity of scholarly publication.

Corrections and Retractions

ICLR is committed to maintaining an accurate and reliable scholarly record.

Where a significant error is identified after publication, the journal may publish a correction or clarification.

Where serious misconduct or fundamental unreliability of published findings is established, ICLR may issue a retraction.

Where an investigation is still ongoing but substantial concerns exist, the journal may publish an expression of concern when appropriate.

Corrections and retractions will be handled transparently and in accordance with recognized publication ethics principles.

Handling Allegations of Misconduct

Any credible allegation of publication misconduct will be treated seriously, objectively, confidentially, and fairly.

ICLR may request clarification or supporting information from the parties involved and will provide reasonable opportunities for them to respond.

Depending on the nature and seriousness of the case, the journal may:

  • request correction of the manuscript;
  • reject the manuscript;
  • issue a correction or clarification;
  • publish an expression of concern;
  • retract a published article; or
  • communicate with the relevant institution or authority where further investigation is necessary.

The purpose of these actions is to protect the integrity of the scholarly record.

Editorial Independence

The Editor-in-Chief and Editorial Board maintain editorial independence in determining whether manuscripts are accepted, revised, or rejected.

The publisher, institutional partners, sponsors, or other parties must not improperly influence editorial decisions.

Academic quality and publication ethics remain the primary considerations in all editorial decisions.
